Choosing the right executors might be the most important part of the Will writing process. To a large extent, acting as an executor is an administrative role requiring knowledge of the deceased’s financial affairs and family. It does, however, carry with it a lot of responsibility and an executor can be held accountable if any mistakes are made.

What we offer

Mercer & Hole Trustees Limited is a trust corporation licensed by the Institute of Chartered Accountants in England & Wales to conduct probate work. The directors of the trust corporation include Mercer & Hole partners, all of whom have extensive private client, trust, and inheritance tax knowledge.

Whilst it is possible to appoint the individual partner who looks after your business and/or personal affairs, appointing Mercer & Hole Trustees Limited has these additional advantages:

  • Unlike an individual, a trust corporation never loses mental capacity nor dies so will always be able to act
  • There are formal protocols in place which dictate the way in which directors of the trust corporation undertake their duties

It is best to appoint at least two or three executors and you will want to select people who are likely to survive you, and who will be fit and capable of doing the job. You may also want to consider if it is practical for that person to be an executor, for example, it can be tricky to administer an estate if your executor lives abroad. You may also want to think about any awkward assets in other jurisdictions or family friction when making your choices.

We offer a service to hold your Will and letter of wishes (once executed) in safe keeping for you and there is no ongoing charge for this.
